In keeping with this 'one stop' approach we find that instructions can require advice and assistance at any stage of the operational cycle of a restaurant business, from:-
• forming (and thereafter administering) the entity under which the business is going to trade, be it a partnership or limited company.
• acquiring the restaurant premises - before an operator can take possession certain hurdles (e.g. planning and enabling works) may need to be addressed. Without the necessary expertise these matters can add to what may already be a fraught time for the client. More often than not leasehold premises are involved. We have substantial experience in negotiating leases for restaurant clients including drafting commercial lease agreements and restaurant leases.
• dealing with Construction claims and disputes which can unfortunately arise from time to time with the building owner, adjoining owners etc. We have a dedicated department experienced in resolving these Construction claims and disputes. We can also ensure the clients' position is adequately protected in the relevant building contract and in warranties to be obtained from the professional team.
• licensing - any establishment which supplies alcohol to its customers, sells hot food or drink after 11pm or provides regulated entertainment must hold a premises licence. We are fully conversant with the licensing regime under the Licensing Act 2003 and are now practised in making the necessary applications for premises and personal licences, and applications for variations of premises licences where an establishment's circumstances have changed.
• employment - a restaurant relies on its staff and staff rely on their employers. This is a rapidly evolving area of law where specialist advice is essential. Glovers can advise on implementing standard form contracts and systems for the management of the employer/employee relationship; recent developments in the law; the range of occasions where an employee's contract of employment needs to be terminated and general advice on the application of the Asylum & Immigration Act 1996 (as amended).
