The unit represents a wide variety of commercial and individual clients, including landlords and tenants in both the commercial and residential sectors, institutional lenders, property investors, developers, retailers and licensed establishments, estate agents, hospitals, and private and public companies.
The unit has a number of clients in common with Glovers’ Commercial Property, Construction, Banking and Finance and Corporate departments, and often works closely with those departments to deal with any potential problems before or as they arise.
The Property Litigation Unit has a wealth of experience of landlord and tenant claims, and deals with a variety of matters, including:-
- 1954 Act (business lease) renewals and terminations
- breach of covenants and forfeiture
- dilapidations disputes
- disputes concerning landlord’s consent, e.g. to assign or sublet
- rent and service charge recovery
- rent review disputes
- service charge disputes
- termination of leases and tenancies
The unit also has a great deal of expertise in dealing with a wide range of other property-related disputes, including:-
- boundary and rights of way disputes
- enforcement of judgments (charging orders and orders for sale)
- planning/development and conveyancing disputes
- possession proceedings
- proceedings involving the Leasehold Valuation Tribunal, the Adjudicator to the Land Registry and the Lands Tribunal
- ransom strip disputes
- trespass, nuisance, restrictive covenants and easements
It is often the case that property litigation disputes involve an element of banking, fraud or negligence, as these areas are commonly connected. As part of Glovers’ wider Litigation and Dispute Resolution Department, the Property Litigation Unit is able to liaise closely with lawyers in Glovers’ Fraud and Asset Recovery, Banking and Finance Litigation and Professional Negligence units and utilise their experience as and when necessary.
