, as head of Glovers’ Professional Negligence Unit, is described in the Legal 500 as an “expert in the field” of professional negligence litigation.
The unit acts for a wide range of predominantly commercial clients. The Professional Negligence Unit originally built its reputation acting for mortgage lenders, banks and other financial institutions, which had suffered as a result of the 1980’s boom and then 1990’s crash of the property market. The aftermath of that produced a surge of professional negligence claims particularly relating to negligent over-valuations. Glovers continues to act for these clients in a broad range of professional negligence cases. These are predominantly property-based negligence claims against surveyors and solicitors who were negligent when acting for the mortgage lender or other financial institution in both commercial and residential secured lending, resulting in the taking of defective or inadequate security. The unit handles claims involving:
- failure to obtain adequate or any title to property
- failure to spot defects
- negligent over-valuations
In cases of this kind there is often a fine line between negligence and fraud. Where that is so, the unit may call upon the expertise of the Fraud and Asset Recovery Unit.
The unit, in conjunction with the Litigation and Dispute Resolution department, often becomes involved in “spin-off” litigations such as complex defended repossessions; Property Litigation such as claims to perfect defective title to property; and other recoveries work in mitigation of the losses suffered by its client professional negligence Claimants.
Glovers’ Professional Negligence Unit also acts for various commercial clients as well as some individual private clients, on professional negligence claims against:
