Philip Eyre wins SCL Millennium Hudson Prize Competition
The Society of Construction Law (SCL) Millennium Hudson Prize was won by Philip Eyre, an associate solicitor in our Construction Department, for his paper entitled "Panatown v MacAlpine - Has the fog cleared yet?"
The SCL Hudson Prize is awarded by the SCL on an annual basis in respect of the best essay on a construction law topic.
The House of Lords' judgment in Panatown v McAlpine is one of the most important decisions concerning the measure of damages for defective building works since Ruxley Electronics v Forsyth some six years ago.
The paper considers the extent to which the Panatown judgment has clarified and developed the law relating to losses sustained by third parties. Building employers sometimes have no proprietary interest in the building works, giving rise to the possibility of a "no loss" defence being raised by the contractor if the employer alleges defective work. A collateral warranty between building owner and contractor may not always permit full recovery of the owner's losses. It is still possible for substantial damages to fall into what is known as a legal "Black Hole".
