Glovers appear in the Privy Council

 

Glovers appeared as Privy Council Agents in the Privy Council on the 14th January in a case to decide whether the Court of Appeal in Gibraltar had erred in ruling that a claim for personal injuries against the Government of Gibraltar should be time-barred. Glovers appeared as Agents for the Appellant against the Attorney General of Gibraltar in a case that touches upon whether the Custody of Parent rule in Gibraltar contravenes the Gibraltar Constitution Order 2006 and the European Convention of Human Rights. The Appellant appealed on the grounds that the Custody of Parent rule in Gibraltar discriminates between a child judged to be within the custody of a parent and a child judged to be without the custody of a parent. The Appellant contended that the discrimination caused by the Custody of Parent rule is unjust, that it contravenes the Constitution of Gibraltar and that it is at odds with the development of the law on limitation in the United Kingdom. The Appellant sought the Privy Council’s ruling on the legality of the Custody of the Parent rule and whether it should be removed or amended.
