Under the Licensing Act 2003, any establishment supplying alcohol, providing late night refreshment (hot food or drink after 11pm) or regulated entertainment (e.g. recorded or live music, facilities for dancing) to its customers, is required to have a premises licence in order to carry out such licensable activities at the property. This new regime has replaced the former system of justices’ liquor licences.

If alcohol is to be supplied at the premises, a designated premises supervisor (“DPS”), the person having ultimate responsibility for the sale or supply of alcohol at the premises, must be named on the premises licence. Anyone named as DPS must possess a personal licence in order to qualify for this position of responsibility.

At Glovers Solicitors LLP, we have the requisite expertise in making premises licence applications for establishments such as restaurants, cafes, pubs, bars and hotels. Similarly, we are able to deal with Temporary Event Notices (for occasional or short term licensing). We are also experienced in dealing with applications to transfer and vary premises licences, when licensed premises are acquired and alterations are made to such premises or when changes are made to the nature of the activities carried out from the premises.

If outside seating is to be provided, we can advise on and make the necessary ancillary applications for pavement café licences (otherwise known as “street trading licences” or “tables and chairs licences”) and for planning consent if required.

Additionally, we can deal with applications for personal licences and for variations of the DPS named on the premises licence.
