We have significant experience in the handling of a wide range of contentious Construction matters. These matters are typically multi-party actions that may involve claims for defects, extensions of time for payment as well as claims concerning the performance of construction professionals. We also specialise in disputes between residential occupiers and their builders and other members of the construction team, particularly using the Construction Conciliation Procedure (www.ccgroup.org.uk).
Project Documentation
We provide advice on the structuring of contractual arrangements and the standard forms appropriate to particular procurement methods.
Once a procurement method has been established we can assist in the drafting, amending or negotiation of construction agreements including appointments of professional consultants. We frequently advise on collateral warranties, parent company guarantees, performance bonds, novation agreements, letters of intent and assignments.
Adjudication
Adjudication has been designed to be a quick way of obtaining an adjudicator's decision without the need for extensive documentation or lengthy legal submissions.
Adjudicators are faced with significant time constraints. We can assist parties to adjudication by defining the issues and ensuring that submissions are presented to the adjudicator, concisely, completely and clearly. We can also advise on the procedural and enforcement aspects of Adjudication. Both and are accredited Adjudicators. Philip Eyre is a dual qualified Solicitor and Chartered Quantity Surveyor.
