Adjudication
Glovers has acted as party representative in numerous adjudications. We will often agree to work within defined financial caps or budgets that make us very competitive when compared with non-solicitor claims consultants offering the same service. As a firm of solicitors, Glovers has the advantage of being able to offer a seamless “one-stop-shop” for adjudication representation and subsequent Court enforcement.
For the nomination of an adjudicator we will make representations to the ANB about the qualifications required of the adjudicator. In written submissions to the adjudicator we aim for brevity and clarity to ensure that the adjudicator understands the case advanced and is not swamped with unnecessary information. We will reserve jurisdiction or address jurisdictional objections as necessary.
We will advise the client upon any terms proposed by the adjudicator and seek the agreement of those terms where appropriate.
For meetings with the adjudicator, we will prepare and undertake advocacy, involving the client as far as possible.
We will advise the client on liability for the adjudicator’s fees and the situations where it might be necessary for payment to be made to the adjudicator. We will provide the client with an estimate of the likely amount of the adjudicator’s fees. Upon receipt of a decision, we will advise upon the need for the adjudicator to correct slips or errors and seek correction if required.
The objective of our service, provided by an experienced dual-qualified construction professional, is to minimise the irrecoverable costs of the process as far as possible.
